Terms of Service

1. Acceptance of Terms

By installing and using FitmentPro ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

These terms apply to all users of the App, including merchants who install the App on their Shopify stores.

2. Description of Service

FitmentPro is a Shopify application that allows merchants to add vehicle compatibility data to their products. The App provides:

• Vehicle database with 55,000+ vehicles
• Product fitment management tools
• Theme blocks for storefront display
• Bulk import and export functionality
• Automation rules for fitment assignment

3. Account and Access

Access to the App requires a valid Shopify store and merchant account. You are responsible for maintaining the security of your Shopify account credentials.

You must provide accurate information during installation and keep your contact information up to date for important service notifications.

4. Subscription and Billing

FitmentPro offers both free and paid subscription plans. Paid plans are billed through Shopify's billing system on a monthly or annual basis.

Free Trial

Paid plans include a 7-day free trial. You will not be charged until the trial period ends. You may cancel during the trial to avoid charges.

Cancellation

You may cancel your subscription at any time through the Shopify admin. Upon cancellation, you retain access until the end of your current billing period.

Refunds

Refunds are provided on a case-by-case basis. Contact support within 7 days of a charge to request a refund.

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse engineer or decompile the App
• Interfere with or disrupt the App's infrastructure
• Share your account access with unauthorized users
• Use automated systems to access the App beyond normal usage
• Resell or redistribute the App or its data

6. Data and Content

Your Data

You retain ownership of all data you input into the App, including custom vehicle rules and templates. We claim no ownership over your content.

Vehicle Database

The vehicle database is provided for use within the App only. You may not extract, download, or redistribute the vehicle database or any substantial portion thereof.

Data Accuracy

While we strive for accuracy, vehicle data is provided "as is" without warranty. You are responsible for verifying fitment data before displaying it to customers.

7. Intellectual Property

FitmentPro, including its code, design, and documentation, is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive license to use the App for its intended purpose.

8. Limitation of Liability

To the maximum extent permitted by law, FitmentPro and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Our total liability for any claims arising from these terms or your use of the App shall not exceed the amount you paid for the App in the 12 months prior to the claim.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Indemnification

You agree to indemnify and hold harmless FitmentPro and its developers from any claims, damages, or expenses arising from your use of the App or violation of these terms.

11. Changes to Terms

We may modify these terms at any time. We will notify you of significant changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the new terms.

12. Termination

We may terminate or suspend your access to the App at any time for violation of these terms or for any other reason at our discretion. Upon termination:

• Your access to the App will be revoked
• Product metafields will remain in your Shopify store
• App configuration data will be deleted within 30 days

13. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
